Transilvaniei nr. 38, Corp C, ap. 2, Bucharest, Romania (KASAI, we, us, our).

1.2  You may contact us at any time by email at contact@kasai-studio.com. We aim to respond to all enquiries within 2 business days.

1.3  KASAI is an online-only premium womenswear brand producing made-to-order and limited-production garments. Our products are sold exclusively through this Website.

2. Scope and Acceptance

2.1  These Terms and Conditions (Terms) govern your access to and use of the Website, including any purchase of products offered for sale on it. Please read them carefully before using the Website or placing an order.

2.2  By using the Website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy, and Returns and Refund Policy, all of which are incorporated by reference.

2.3  If you do not agree with any part of these Terms, you must not use the Website or place an order.

2.4  We reserve the right to amend these Terms at any time. The version in force at the time your order is placed governs that transaction. We will notify registered users of material changes via email.

3. Eligibility and Website Use

3.1  The Website is intended for users who are at least 16 years of age. By using this Website, you confirm that you meet this requirement. Purchases require users to be at least 18 years of age or to have the consent of a parent or legal guardian.

3.2  This Website contains editorial and artistic fashion imagery which may include artistic nudity consistent with the aesthetic standards of the luxury fashion industry. By accessing the Website, you confirm you are of appropriate age and consent to view such content in its intended artistic context.

3.3  Access to the Website is provided free of charge for personal, non-commercial use only. You may not reproduce, copy, distribute, or commercially exploit any part of the Website or its content without our prior written consent.

3.4  You agree not to use the Website in any manner that is unlawful, harmful, or that could damage, disable, or impair the Website or interfere with any other party’s use of it.

3.5  We reserve the right to suspend or withdraw access to the Website at any time without notice and without liability, including for maintenance, security, or legal reasons.

4. Products

4.1  KASAI offers two categories of products:

• In-Stock Items:  garments available for immediate dispatch from existing inventory.
• Made-to-Order Items:  garments produced specifically following receipt and confirmation of your order.

4.2  The product type applicable to each item is clearly indicated on the relevant product page, together with the estimated dispatch window. Product availability and classification may change based on production capacity and inventory. Any such changes will be reflected on the product page prior to purchase.

4.3  All products are sold for personal use only. You agree not to purchase products for commercial resale, export to sanctioned territories, or any other commercial purpose.

4.4  We have made every reasonable effort to display our products accurately, including colours, textures, and dimensions. Due to variations in screen calibration and display settings, we cannot guarantee exact colour reproduction. This does not constitute a defect.

4.5  KASAI garments are produced in small batches with attention to craft and quality. Minor natural variations inherent to handcraft production are not considered defects and are part of the character of the product.

5. Orders and Contract Formation

5.1  Placing an order on the Website constitutes an offer to purchase the selected products under these Terms. The contract between you and KASAI is formed only when we send you an order confirmation email confirming that your payment has been successfully processed and your order accepted.

5.2  Prior to this confirmation, we reserve the right to decline your order for any reason, including but not limited to product unavailability, pricing errors, or payment issues. If we decline your order after payment has been taken, we will issue a full refund promptly.

5.3  You are responsible for ensuring all information provided at checkout, including delivery address, contact details, and size selection, is accurate and complete. KASAI accepts no liability for orders that cannot be delivered or processed due to customer error.

5.4  Once an order has been confirmed, it enters our production or fulfilment queue immediately. Cancellation requests after confirmation are subject to Section 9 of these Terms.

5.5  Your order confirmation email constitutes the contractual document for your purchase. We recommend you save or print it for your records.

6. Pricing and Availability

6.1  All prices displayed on the Website are shown in EUR for international customers and RON for Romanian customers. Prices are inclusive of Romanian VAT where applicable.

6.2  For orders delivered within the European Union, prices are inclusive of applicable VAT. No additional tax will be charged at delivery.

6.3  For orders delivered outside the European Union, the displayed price does not include import duties, customs fees, local taxes, or any other charges levied by the destination country’s authorities. These charges are entirely the responsibility of the recipient and will be collected by the carrier or customs authority upon delivery. KASAI has no control over and no liability for these charges. We recommend you contact your local customs authority before placing an order if you are uncertain about applicable charges.

6.4  We reserve the right to modify prices at any time. Price changes will not affect orders that have already been confirmed.

6.5  In the event of a pricing error on the Website, we will notify you as soon as possible and offer you the option to proceed at the correct price or cancel your order with a full refund. We are under no obligation to fulfil an order placed at an incorrect price.

7. Payment

7.1  Payment is due in full at the time of placing your order. We do not operate a deposit or partial payment model.

7.2  We accept payment via the following methods, processed securely through Netopia Payments:

• Visa and Mastercard (credit and debit)
• Google Pay
• Apple Pay
• Bank transfer (where available)

7.3  Your payment details are processed exclusively by Netopia Payments, our authorised payment service provider. KASAI does not store, access, or retain your card details at any point.

7.4  Your order will not enter production or fulfilment until full payment has been confirmed. In the case of bank transfer, your order will be queued from the moment funds are received in our account.

7.5  All transactions are subject to validation and authorisation by your card issuer. KASAI accepts no liability for delays caused by payment authorisation processes.

8. Production, Dispatch and Delivery

8.1  Dispatch Windows

The estimated dispatch window for each product is stated on the product page. As a general guide:

Business days means Monday to Friday, excluding Romanian public holidays. During periods of high order volume or events outside our control, dispatch may be delayed. We will notify you promptly in such cases.

8.2  Delivery Estimates

Estimated delivery times after dispatch are provided for guidance only and are not guaranteed:

8.3  Delivery timeframes are estimates provided by our courier partners and are not guaranteed. KASAI is not liable for delays caused by couriers, customs processing, incorrect addresses provided by the customer, or events outside our reasonable control.

8.4  Shipping is free of charge for all orders delivered within Romania and the European Union. For orders outside the EU, shipping is free on orders of €900 or above. For international orders below this threshold, the applicable shipping cost will be clearly displayed at checkout.

8.5  Once your order has been dispatched, you will receive a shipping confirmation email with a tracking reference.

8.6  Risk in the goods passes from KASAI to the courier upon dispatch and from the courier to you upon delivery. If a parcel is lost or damaged in transit, please contact us at contact@kasai-studio.com within 48 hours of the expected delivery date.

8.7  For deliveries outside the EU, you are responsible for complying with all applicable laws and regulations in the destination country.

8.8  If delivery is unsuccessful due to the recipient being unavailable, the courier will leave a notification. KASAI accepts no liability for orders returned to sender due to failed delivery attempts resulting from customer error or inaction.

9. Returns, Withdrawal and Cancellations

9.1  Your Right of Withdrawal

In accordance with Romanian Law (OUG 34/2014) implementing EU Directive 2011/83/EU, if you are a consumer resident in the European Union, you have the right to withdraw from your purchase contract within 14 calendar days of the date on which you or a nominated third party physically receives the goods, without providing any reason.

9.2  Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

• (a)  Garments made to your specific measurements or clearly personalised at your request, pursuant to Art. 16(c) of Directive 2011/83/EU.
• (b)  Items that have been worn, washed, altered, or damaged after delivery.
• (c)  Items returned without their original KASAI tags, labels, and packaging.
• (d)  Sealed items not suitable for return for hygiene reasons, once unsealed after delivery.

Standard made-to-order items produced from fixed size and colour options without personalisation retain the full 14-day withdrawal right.

9.3  How to Initiate a Return

Notify us clearly and in writing before the 14-day withdrawal period expires by emailing contact@kasai-studio.com with your order number, the item(s) you wish to return, your reason for return (optional), and whether you prefer a cash refund or store credit. We will respond within 2 business days with return instructions.

9.4  Return Shipping

Items must be returned within 14 calendar days of notifying us of your withdrawal.

We do not accept returns shipped via Romanian Postal Service (Poșta Română) under any circumstances. Accepted couriers: Fan Courier, DHL, DPD, Cargus, GLS.

9.5  Refunds

(a) Cash Refund:  Processed within 14 calendar days of receipt and inspection. Includes original standard delivery cost where applicable. Issued via original payment method.

(b) Store Credit:  Issued within 5 business days of receipt and inspection. Valid for 12 months. Non-transferable and cannot be redeemed for cash.

(c)  For non-EU store credit returns, credit is issued at 110% of the purchase price.

9.6  We reserve the right to reduce the refund amount to reflect any diminution in value caused by handling beyond what is necessary to assess the garment.

9.7  We reserve the right to refuse a return that does not comply with these conditions.

9.8  Order Cancellations

(a) Before dispatch:  Contact us immediately at contact@kasai-studio.com.

(b) After dispatch:  Not possible. Initiate a return upon delivery per Section 9.1.

(c) Made-to-order in active production:  A partial production cost recovery may apply, communicated transparently before any deduction. This does not affect your statutory right of withdrawal upon delivery.

10. Product Conformity and Legal Guarantee

10.1  KASAI is legally obliged to deliver goods that conform to the contract of sale. In accordance with Romanian law implementing EU Directive 2019/771, you benefit from a legal guarantee of conformity of 2 years from the date of delivery.

10.2  Where a product is found to be non-conforming, our first commitment is always to repair or replace the item at no cost to you. Where repair or replacement is genuinely impossible, disproportionately costly, or cannot be completed within a reasonable timeframe, Romanian law provides that you may request a proportional reduction of the price paid or, where the non-conformity is material, rescission of the contract and a full refund. These are statutory remedies and will only apply in exceptional circumstances.

10.3  To report a non-conformity, contact us at contact@kasai-studio.com within 48 hours of delivery with your order number, a description of the defect, and photographs where possible.

10.4  The legal guarantee does not cover normal wear and tear, improper care, accidental damage, or modifications made by you or a third party.

11. Limitation of Liability

11.1  Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by Romanian or EU law.

11.2  Subject to Section 11.1, KASAI’s total liability to you in connection with any order shall not exceed the total amount paid by you for the products in that order.

11.3  KASAI is not liable for indirect or consequential losses, loss of profit or business opportunity, losses arising from events outside our reasonable control, or courier delays once goods have been dispatched.

11.4  The Website is provided for personal consumer use only. These Terms do not affect your statutory rights as a consumer under applicable Romanian and EU law.

12. Events Outside Our Control

12.1  KASAI will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, fire, flood, storm, pandemic, government action, labour disputes, or failures of telecommunications infrastructure.

12.2  In such circumstances, we will contact you as soon as reasonably possible. If the event lasts more than 30 calendar days, you will be entitled to cancel your order and receive a full refund.

13. Intellectual Property

13.1  All content on this Website, including brand name, logo, visual identity, photography, editorial content, product descriptions, design elements, and digital assets, is the exclusive intellectual property of KASAI or its licensors, protected under Romanian and international copyright, trademark, and design law.

13.2  You may not reproduce, copy, distribute, publish, transmit, modify, or exploit any content from this Website for commercial purposes without prior written consent from KASAI.

13.3  Any unauthorised use of KASAI’s intellectual property may result in legal action.

14. Privacy and Data Protection

14.1  Our collection, use, and protection of your personal data is governed by our Privacy Policy, available at www.kasai-studio.com/privacy-policy.

14.2  By placing an order, you acknowledge that we will process your personal data as necessary for the performance of the contract and in accordance with EU Regulation 2016/679 (GDPR).

15. Governing Law and Dispute Resolution

15.1  These Terms are governed by the laws of Romania.

15.2  In the event of a dispute, we encourage you to contact us first at contact@kasai-studio.com.

15.3  If a dispute cannot be resolved directly, you may refer the matter to:

15.4  For consumers resident in Romania, the courts of Romania shall have jurisdiction. For consumers in other EU member states, jurisdiction shall be determined in accordance with applicable EU regulations.

16. General Provisions

16.1  Severability:  If any provision of these Terms is found unlawful or unenforceable, that provision shall be severed without affecting the remaining provisions.

16.2  Waiver:  Our failure to enforce any provision on any occasion does not constitute a waiver of our right to enforce it in the future.

16.3  Entire Agreement:  These Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and KASAI.

16.4  Language:  These Terms are available in English (governing version) and Romanian (reference translation). In the event of any inconsistency, the English version prevails.
